Where Is Online Gambling Legal in 2026? A Country-by-Country Guide

By Gambling Consulting ExpertPublished Updated 3 min read

Short answer

Online gambling is legal and licensed in most of Europe (including the UK, Malta, Italy, Spain, Germany, the Netherlands, Denmark, Sweden and Romania), in Ontario and Alberta, in eight US states for online casino, and in Peru and Colombia. It is banned or unlicensable in India, Turkey, Australia (casino and poker) and, since September 2026, Brazil. Legality depends on the player's location, not where the operator is licensed.

This guide replaces our 2021 list. Since then, several large markets have opened, a few have closed, and the rule of thumb has only grown stronger: what is legal depends on where the player is, and most regulated markets require their own local license. Europe

Most European countries license online gambling locally. There is no EU passport.

The Isle of Man, Alderney and Gibraltar license operators that serve other markets, but players in regulated European countries still need to be served under local licenses.

North America

  • Canada: provincial systems. Ontario and Alberta license private operators; other provinces run provincial monopolies.
  • United States: gambling is a state matter. Online casino is legal in New Jersey, Pennsylvania, Michigan, West Virginia, Connecticut, Delaware and Rhode Island, and Maine legislated in January 2026 to become the eighth state. Online sports betting is legal in many more states. See our guides to New Jersey, Pennsylvania and Nevada.

Latin America

  • Licensed: Peru, Colombia, Argentine provinces and Panama.
  • Banned: Brazil, by provisional measure of 25 September 2026.
  • No regime: Chile (bill in the Senate) and Costa Rica.

Asia-Pacific and Middle East

  • India: online money games banned by the 2025 Online Gaming Act — see our India guide.
  • Philippines: offshore gaming banned in 2025; PAGCOR licenses domestic online gaming only — see our Philippines guide.
  • Australia: online casino and poker prohibited; wagering licensed by states and territories — see our Australia guide.
  • China, Japan, Singapore and most of the Middle East: online gambling prohibited or restricted to state operators.
  • Turkey: online gambling prohibited outside the state operators, with active enforcement.

Africa

Several African countries license online betting, often at provincial or state level, including South Africa (betting, through provincial boards), Kenya and Nigeria. Online casino is prohibited or unregulated in many of them.

What this means for operators

  1. Choose target markets first, then the licenses they require.
  2. Use a hub license such as Malta or Curaçao only for markets where it is lawful to do so.
  3. Geo-block every market where you are not authorized.

Frequently asked questions

Is online gambling legal everywhere in the EU?

No. There is no EU-wide license. Most member states license online gambling locally, but some keep monopolies or restrictions — for example, online casino is a state monopoly in Poland and not licensed in France, and Cyprus licenses online betting only.

In which US states is online casino legal?

New Jersey, Pennsylvania, Michigan, West Virginia, Connecticut, Delaware and Rhode Island, with Maine becoming the eighth state after legislation in January 2026. Online sports betting is legal in many more states.

Which countries changed their rules since 2021?

The Netherlands (2021), Ontario (2022), Peru (2024), Ireland (betting licenses from 2026) and Alberta (2026) opened regulated markets. India banned online money games in 2025, the Philippines banned offshore gaming in 2025 and Brazil, which opened in 2025, banned betting and online casino in September 2026.

Does an offshore license make online gambling legal in my country?

No. What is legal depends on the law where the player is located. A Curaçao, Malta or other license authorizes the operator under that jurisdiction's law but does not override local prohibitions or license requirements.

Is online gambling legal in Canada?

Yes, through provincial systems. Ontario and Alberta license private operators; other provinces offer online gambling through provincial lottery corporations.
